ERS Board adopts new rules and amendments at its December 2021 meeting

The November newsletters noted the ERS Board of Trustees would consider proposed rule amendments at its Dec. 7 meeting.

At the meeting, the Board added new rules: 

  • Chapter 69: Sections 69.2, 69.3, 69.4, 69.5 and 69.6 were added to implement Tex. Gov’t Code Section 810.003, enacted by the 85th Legislature, Regular Session (2017) in S.B. 500, and Section 810.004, enacted by the 86th Legislature, Regular Session (2019) in S.B. 1570. These statutory provisions require the termination of annuities of certain elected officials and corrections employees convicted of specified felonies related to their duties.

The Board also adopted the following amendments:

  • Chapter 63: Sections 63.1, 63.3, 63.4, 63.5, 63.7, 63.9, 63.13, 63.15, 63.17 and 63.19 were amended to implement statutory requirements in HB 917 of the 87th Regular Legislative Session.
  • Chapter 85: Sections 85.1, 85.4 and 85.7 were amended to clarify their interaction with the new Section 85.6. Section 85.6 was added to implement the requirements of Section 214 of the Federal Taxpayer Certainty and Disaster Tax Relief Act of 2020 and other relevant federal law.

In addition, the Board adopted amendments to the following rules to clarify the intent of the rules and their interaction with other rules and statutes, and enhance public understanding:

  • Chapter 61: Section 61.1
  • Chapter 63: Sections 63.1, 63.3, 63.4, 63.5, 63.7, 63.9, 63.13, 63.15, 63.17 and 63.19
  • Chapter 65: Sections 65.1, 65.5, 65.7, 65.9, 65.11 and 65.13 
  • Chapter 69: Sections 69.1, 69.7, 69.8 and 69.9
